Utah Special Education Law
Utah special education law is designed to ensure that students with disabilities receive the educational services and supports they need to succeed in school. These protections are established through the federal Individuals with Disabilities Education Act (IDEA) and implemented through the Utah State Board of Education’s Special Education Rules and regulations.
Every eligible student is entitled to a free appropriate public education (FAPE) tailored to their unique needs. Schools must identify students who may qualify for special education services, conduct evaluations, and develop individualized plans that provide meaningful educational benefits.
One of the most important components of special education is the Individualized Education Program (IEP). The IEP serves as a roadmap for a student’s educational services, accommodations, goals, and support. Parents are valuable members of the IEP team and have the right to participate in decisions affecting their child’s education, review records, and advocate for appropriate services.
Families often find the special education process confusing and difficult to navigate. Questions may arise regarding eligibility, evaluations, accommodations, behavioral supports, classroom placement, related services, or whether a school district is properly implementing an IEP. Understanding your legal rights can help ensure your child receives the educational opportunities they deserve.
Utah schools are also required to educate students with disabilities in the least restrictive environment (LRE) whenever appropriate. This means students should have opportunities to learn alongside their non-disabled peers while still receiving the specialized instruction and services necessary to meet their individual needs.

Frequently Asked Questions
What Is the Special Education Law in Utah?
Special education services in Utah are governed by the federal Individuals with Disabilities Education Act (IDEA) and the Utah State Board of Education’s Special Education Rules. These laws establish the rights of students with disabilities and require public schools to provide qualifying students with a free appropriate public education tailored to their individual needs.
What Qualifies a Child for an IEP in Utah?
A child may qualify for an IEP if an evaluation determines that they have a disability recognized under IDEA and that the disability affects their educational performance to the extent that special education services are needed. Eligibility is determined through a comprehensive evaluation process and consideration by an IEP team. Qualifying disabilities may include specific learning disabilities, autism, speech or language impairments, emotional disabilities, hearing impairments, visual impairments, intellectual disabilities, and other recognized conditions.
What Are the Two Legal Mandates for Students with Disabilities Under IDEA?
Each student with disabilities must be provided with a Free Appropriate Public Education (FAPE) in the Least Restrictive Environment (LRE).
Does a Child with Autism Automatically Qualify for an IEP?
No. After diagnosis, the school will conduct a separate educational evaluation to determine which services may be needed and whether your child qualifies for an IEP.
